Imagine a migrant worker, assigned the role of Senior Care Assistant. On paper, everything seemed compliant. The job description was clear, the salary was correct, and the Certificate of Sponsorship (CoS) was issued in good faith. But the Home Office interview changed everything.

The Prestwick Care Lesson

In the Prestwick Care Ltd v Home Office case, the Home Office revoked a sponsor licence because migrant workers assigned as Senior Care Assistants couldn’t demonstrate their roles matched the job description on their CoS. Instead of leading teams, supervising carers, and handling emergencies, their answers suggested they were performing the tasks of a basic care assistant. 

The result? The Home Office deemed these roles as not genuine vacancies, uncovering a breach that cost the sponsor their licence.

When a Breach Is Found in the First Sentence

During one of our training sessions, we replicated this exact scenario. We conducted mock interviews with migrant workers, simulating the intensity of a Home Office inspection. 
 
In the very first sentence of the first migrant’s response, the breach was glaring:
